SCOTTSBORO - The National Collegiate Athletic Association is fighting the inclusion of David Swank, former chairman of its Committee on Infractions, as an expert witness in a lawsuit recently filed by disassociated University of Alabama booster Ray Keller of Stevenson.

Judge dismisses two claims in countersuit by UA artist
Two claims in a countersuit brought by sports artist Daniel Moore stemming from a trademark case have been dismissed by a federal judge. U.S. District Judge David Proctor, following an Oct. 27 hearing, dismissed Moore's claims that University of Alabama officials violated the Visual Artists Rights Act and the Alabama Deceptive Trade Practices Act when the university changed from crimson to green the color on uniforms and jerseys on a Web site depicting his work for a survey. Another claim was dismissed by agreement between lawyers for Moore and the university.

Has Title IX has run its course?
There are times where the stars align and issues that span more than just the world of sports collide. The impending hearings to confirm John Roberts as the country's next Supreme Court Justice will most certainly focus on his opposition to Title IX. Also, this past week, Wisconsin Badgers Head Football Coach Barry Alvarez announced that the 2005 season would be his last. Alvarez will still continue to act as Athletic Director for the university.

Koetter and Smith erred in Wade case, report says
Arizona State University's former athletic director and the head football coach made errors in judgment in how they acted after being warned of dangerous behavior by football player Loren Wade, according to an investigative report issued Monday. Wade, 21, is suspected of shooting former ASU football player Brandon Falkner in March after he saw his former girlfriend talking to Falkner outside a Scottsdale nightclub.

Auto racing and the Title IX myth-makers
We love to make our sports stars into mythic figures. It is comforting to believe in cultural myths, like the stories we read to children about George Washington chopping down a cherry tree. However, in order to construct these unreal icons, one needs to create a little fiction. Interestingly, the same holds true when it comes to reporting on Title IX.
